Frequently asked Questions (FAQs) regarding the role of a NSW Justice of the Peace.
General questions
There are a number of significant steps to take that are
not covered in the handbook. You can follow the steps in
this document.
Processing Probate Affidavit. Its an easy step by
step information page. There is also a complete check
list issued by the Supreme Court.
Checklist_Probate Which gives detailed instructions,
and is very comprehensive. You could also check
this important update published by the NSW Justice
Association Inc in the March 2026 edition of their
Journal.

There are a number of documents available including
instructions in the JP Handbook. But there is a
comprehensive document issued by the Federal Court of
Australia as a downloadable word document.

Question 5, The NSW JP Handbook is complicated to find information quickly. Is there a quick reference for my to find information without looking at the Handbook? There's also this document Interstate Documents
The handbook is seperated into a number of different
sections. However most of the sections are not
always relevant while you're performing your JP duty,
and want help quickly, they are Section 2 and Section 4
referenced here for your information;
1) Section 2 of the JP Handbook, Performing your functions - Witnessing a Stat Dec, Witnessing an Affidavit, Certifying Copies, Services for Linguilistically diverse background, Witnessing for people who do not speak English, Providing services for people with disabilities, FAQ's about performing a JP service.

All NSW JP's must be listed on the Public Register.
Legislation changed a short while ago, and the
Government introduced an exam which all JP's must now
take every 5 years with a 100% accuracy.
Many JP's decided not to take this exam and its possible
their registration has lapsed, sometimes without their
knowledge. As a result, these people may no longer
be registered and will be committing a serious offence
if they act in the capacity as JP whilst not registered
to do so. Additionally, any documents that have been
process by this person may be invalid.
